WORK PERMIT
Foreigners working for enterprises, representative offices, branches of foreign enterprises, projects and bidding packages in Vietnam, … need to apply for a Work Permit to be allowed to work legally in Viet Nam. In addition, the Work Permit is also a condition for issuing visa, granting temporary residence card for foreigners who are allowed to immigrate and stay in Vietnam for a long term.
Currently, in addition to the provisions of the Labor Code 2012, the procedures for granting Work Permit are specified in Decree 11/2016 / ND-CP, Circular 40/2016 / TT-BLĐTBXH. Accordingly, the procedure for applying for a Work Permit includes:
Step 1: Apply for approval of the provincial People’s Committee on the use of foreign workers. The employer must submit an explanation report on the need to use foreign workers at least 30 days from the expected date of employment.
Step 2: Apply for a work permit for laborers at the provincial Department of Labor, War Invalids and Social Welfare.
The process lasts from 30 to 45 days.

Documents issued by foreign organizations must be consular legalized to be used in Vietnam.
Foreigners can do Judicial profile in Vietnam. Results will be available after 24 working days from the date the foreigner submits the application at the provincial Department of Justice where the foreigner resides.
